State Overtime Laws

The Fair Labor Standards Act (FLSA) was established to address minimum wage, overtime pay, and employment standards for employees in the private sector. FLSA covers Federal, State, and local governments. Even though the FLSA laws have been established, many states have their own minimum wage and overtime laws.

Overtime is a very complex topic as several states have different rules and regulations regarding overtime and what is counted as overtime. Most business owners don’t have the capacity and time to fully navigate all the complexities of overtime laws. Hence we put together a guide for overtime laws by state.

Overtime Laws by State

As of July 24th 2009, the FLSA established a minimum wage of $7.25 and an overtime pay for hours worked over 40 per work week. The FLSA does not establish a daily overtime threshold. In cases where there is a conflict between federal and state overtime rules, the law that favors the employee the most wins.
